The Department of Home Affairs, has recently made significant announcements that brings greater certainty for TSS visa holders and their journey towards permanent residency in Australia. We're thrilled to share that by the end of 2023, the Department has announced that all TSS (subclass 482) visa holders will have a clear pathway to permanent residency in Australia.

Previously, the pathway to permanent residency was available for TSS visa holders who had occupations in the medium long term stream. Under these new provisions, all TSS visa holders (including those in the short term occupation stream), will be eligible to apply for permanent residence. Under this pathway to permanent residence, the Department previously required three years of employment, but has since announced that this requirement will be reduced to just two years of sponsorship through the Employer Nominated Scheme (subclass 186) visa in the Temporary Residence Transition (TRT) stream. This update is fantastic news for TSS visa holders who will be able to continue building their lives in Australia.

To make the most of this opportunity, it's crucial for TSS visa holders to continue abiding by all their visa conditions including working in their nominated occupation for their sponsored employer. Additionally, TSS visa holders will need to continue to meet all other nomination and visa requirements for the TRT stream of the Employer Nomination Scheme, such as health, character, and age criteria. By staying committed and fulfilling these prerequisites, all 482 visa holders will be eligible for the transition to permanent residency.

Further, the Department has announced the removal of the limitation on short-term stream TSS visa applications made onshore in Australia. In the past, applicants would typically leave Australia before becoming eligible for permanent residency through the TRT stream. However, with this restriction lifted, visa applicants can now complete two years with their employer within Australia, eliminating the need for offshore visa applications and potential disruptions to personal and professional life.
